the Water with Swimply

The COVID-19 pandemic is forcing many people across the
world to look for new forms of entertainment because of the
restrictions placed on large crowds. One idea that has taken off during
the pandemic, perhaps as a response to many public pools being closed,
is homeowners renting out their private pools by the hour through an
online, app-based service. But how does this work in a property owners
association (POA), and what potential problems and risks for the POA
may arise?

Short-Term Rental Update, Plus More Information on
Operating a Business from Home
By Leah K. Burton
Amid a recession with rising unemployment rates and an
ongoing pandemic, homeowners are spending more time at home. Some have
been forced to work from home due to COVID-19, while others are looking
for ways to make extra money. One method some homeowners are employing
to earn additional income is a short-term rental of their entire home
or even just a spare bedroom. Others are attempting to start their own
business, or continuing to run their existing business out of their
home. But what happens for those home/business owners who live in a
property owners association (POA)? Are they able to host a short-term
rental, or operate a business out of their home?

Short-Term Rentals and Operating a Business from
Home
COVID-19
has forced many people across our state to modify the way they live and
work. Many people are having to work from home, some may be even
operating their business out of their home, and others have lost their
job and are looking for alternative ways to make an income. As a
result, short-term rentals are becoming more prevalent in our
communities.
Join
Shareholder Leah K. Burton and Associate Paul Gaines of our San Antonio
Office as they explain what action, if any, POAs can take against
short-term rentals and new case law surrounding short-term rentals.
Leah and Paul will also discuss how POAs can address owners operating a
business from their home.
