With COVID-19 Shelter-in-Place Orders firmly in place for cities, counties and the State of Texas, many community managers and board members are asking how bankruptcy is being affected. The short answer is not much. Overall, owners in property owners associations (POAs) experiencing financial difficulty are still filing Chapter 7 and Chapter 13 bankruptcies. Bankruptcy courts in the Southern, Eastern, Western and Northern Bankruptcy Districts and trustees are still holding meetings and hearings. The main difference we are seeing is that rather than in person meetings and hearings, they are being held virtually.
